TERMS AND CONDITIONS

Effective Date: 4/1/2023
Business Name: Great Lakes Victory Auto 

1. GENERAL AGREEMENT

By using our services, requesting repairs, or authorizing any work, you (“Customer”) agree to the following Terms and Conditions. These terms apply to all services, estimates, diagnostics, and repairs performed by our shop.

2. ESTIMATES & AUTHORIZATION

  • All estimates are non-binding and may change upon further inspection. 
  • Additional repairs may be required once work begins. 
  • Customer authorization (verbal, written, or electronic) is required before proceeding. 
  • We are not responsible for incomplete or inaccurate information provided by the customer. 

3. LABOR & SERVICE

  • Labor is charged based on industry-standard labor times or actual time spent. 
  • Diagnostic fees are non-refundable, regardless of repair outcome. 
  • We are not responsible for pre-existing conditions or hidden damage discovered during repairs. 

4. PARTS POLICY & WARRANTY DISCLAIMER

OEM Parts (Dealer-Supplied Only)

  • Warranty is provided on both parts and labor. 
  • Warranty applies only to genuine OEM parts purchased through authorized dealership sources. 

Aftermarket / Customer-Supplied / Online Parts (Amazon, eBay, etc.)

  • NO WARRANTY ON PARTS. 
  • LABOR WARRANTY ONLY applies to installation workmanship. 
  • If a part fails: 
    • Replacement labor is NOT FREE. 
    • Customer is responsible for all additional costs. 

“OEM-Equivalent” or Third-Party Labeled Parts

  • Treated as aftermarket parts. 
  • NO PART WARRANTY PROVIDED. 

Used / Salvage Parts

  • NO WARRANTY ON PARTS OR LABOR. 

5. WARRANTY LIMITATIONS

  • Standard labor warranty (if applicable): 12 months or 12,000 miles, whichever comes first. 
  • Warranty covers workmanship only, not part failure (unless OEM dealer part). 
  • Warranty does NOT cover: 
    • Misuse, neglect, or accidents 
    • Overheating, lack of maintenance 
    • Towing, commercial or heavy-duty use (unless agreed) 
    • Related or unrelated system failures 
  • All warranty repairs must be performed exclusively at our shop. 

6. PAYMENT TERMS

  • Full payment is required before vehicle release. 
  • We accept cash, card, or approved payment methods. 
  • Unpaid balances may result in: 
    • Storage fees 
    • Mechanic’s lien 
    • Legal collection actions 

7. STORAGE POLICY

  • Vehicles must be picked up within 3 business days after completion. 
  • After that: $20 per day storage fee (or adjust to your number). 
  • Vehicles left unpaid or unclaimed may be subject to lien and sale per state law. 

8. CUSTOMER-SUPPLIED VEHICLES & CONDITIONS

  • Customer confirms vehicle condition is accurately described. 
  • We are not responsible for: 
    • Existing mechanical issues 
    • Electrical problems unrelated to repair 
    • Failures caused by worn or damaged components 

9. TEST DRIVES & OPERATION

  • We may operate and test drive vehicles for diagnostic and verification purposes. 
  • Customer authorizes shop personnel to operate the vehicle as needed. 

10. LIMITATION OF LIABILITY

  • We are NOT liable for: 
    • Loss of use of vehicle 
    • Loss of income 
    • Towing, rental, or inconvenience costs 
  • Our liability is strictly limited to the amount paid for the specific service. 

11. ABANDONED VEHICLES

  • Vehicles left over 30 days without payment or communication may be considered abandoned. 
  • Subject to lien sale under Ohio law. 

12. PARTS RETURN POLICY

  • Old parts may be discarded unless requested in advance. 
  • Special order parts are non-refundable. 

13. NO GUARANTEE OF OUTCOME

  • Some repairs are based on diagnosis that may not fully resolve the issue. 
  • We do not guarantee fixing intermittent or complex issues in one visit. 

14. MODIFICATIONS & PERFORMANCE WORK

  • Any performance upgrades, tuning, or modifications are done at customer’s risk. 
  • No warranty provided on modified systems unless explicitly stated. 

15. ELECTRONICS & PROGRAMMING

  • Programming and calibration services are non-refundable. 
  • We are not responsible for software limitations or manufacturer restrictions. 

16. INDEMNIFICATION

Customer agrees to indemnify and hold harmless the shop from any claims arising from:

  • Customer-supplied parts 
  • Unauthorized modifications 
  • Failure to follow recommendations 

17. GOVERNING LAW

These terms are governed by the laws of the State of Ohio.

18. ACCEPTANCE

By approving any estimate or service, the customer confirms they:

  • Have read these Terms and Conditions 
  • Agree fully to all policies stated above
